TERMS AND CONDITIONS OF USE
“Jobs by Baji” (“Platform”), is a service provided, owned and operated by OFFICE PILOT (PRIVATE) LIMITED (registered address at No, 252A, Galle Road, Colombo 04, Sri Lanka.), subject to your compliance with the Terms and Conditions set forth below.
1. Language Availability and Request for Translations
a) If you require a copy of these Terms and Conditions in Sinhalese or Tamil, you may submit a written request by email to the Email Address support@jobsbybaji.com, Upon receipt of a valid request, the Company shall provide the requested version within a reasonable period, subject to Applicable Law.
b) මෙම නියමයන් සහ කොන්දේසි වල පිටපතක් සිංහල හෝ දෙමළ භාෂාවෙන් ඔබට අවශ්ය නම්, ඔබට support@jobsbybaji.com විද්යුත් තැපැල් ලිපිනයට විද්යුත් තැපෑලෙන් ලිඛිත ඉල්ලීමක් ඉදිරිපත් කළ හැකිය. පිටපතක් සඳහා වලංගු ඉල්ලීමක් ලැබුණු පසු, අදාළ නීතියට යටත්ව, සාධාරණ කාලයක් තුළ සමාගම විසින් එම ඉල්ලා සිටින පිටපත ලබා දීමට කටයුතු කරනු ඇත.

2. Acceptance, Applicability, and Binding Effect
a) By accessing or using this Platform and any products, services, information, features, or content provided under the name and style of “Jobs by Baji”, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions of Use and the Privacy Policy herein.
b) If you do not agree, you must immediately discontinue access to and use of the Platform and any products, services, information, features, or content provided under the name and style of “Jobs by Baji”.
c) Continued use of the Website constitutes ongoing acceptance of these Terms, as amended from time to time. We reserve the right to modify these Terms at its sole discretion subject to terms herein, and such modifications shall take effect upon publication on the website of the Platform.
3. Definitions and Interpretation
In these Terms & Conditions, unless the context otherwise requires:
a) “Platform” means the website, web application, and any related services operated by the Company under the name and style of “Jobs by Baji”.
b) “Company”, “We”, “Us”, or “Our” means the provider, owner and operator of the Platform named above.
c) “User” means any natural person who accesses or uses the Platform, provided that such person is not excluded, restricted, or barred from use under these Terms and Conditions or any applicable law.
d) “Job Site Owner” means any third party that owns or operates a job board, recruitment website, or employment listing platform.
e) “Services” means the CV analysis, job-matching, job discovery, and referral link services provided through the Platform.
f) “Content” includes CVs, resumes, text, data, links, and any information uploaded or generated through the Platform.
g) “Applicable Law” means all laws, regulations, and legal requirements applicable in Sri Lanka and the jurisdiction of the User.
h) “CV” means any curriculum vitae, résumé, profile, employment history, qualifications, skills, experience, personal statements, or other professional or career-related information uploaded, submitted, generated, or stored by a User on or through the Platform, whether in document, text, structured data, or other digital form.
i) “Email Address” shall mean support@jobsbybaji.com, which is the official email address designated by the Company and published on the Platform for communications, notices, and requests specified under these Terms.
j) “Contact Number” shall mean +94 77 831 2087, which is the official telephone or mobile number designated by the Company and published on the Platform for communications specified under these Terms.
k) “Online Form” shall mean the online form made accessible via the link https://forms.gle/6KSVjaKCfYz7Ayk38 and made available by the Company on the Platform, for the submission of inquiries, requests, complaints, or notices specified under these Terms.
4. Eligibility and Exclusion of Users
a) The Platform is intended solely for use by persons who are legally competent to contract under the Applicable Law.
b) Minors, defined as persons below the age of majority under Applicable Law, are strictly prohibited from registering, accessing, or using the Platform.
c) By using the Platform, the User represents and warrants that they are not a minor and are legally capable of entering into a binding contract under Applicable Law.
d) Any individual who misrepresents or falsely confirms that they are not a minor and that they possess the legal capacity to enter into a binding contract under Applicable Law does so entirely at their own risk, and shall have no right, claim, or cause of action against, nor be entitled to hold liable, the Platform and/or the Company for any loss, damage, liability, or consequence whatsoever arising out of or in connection with such access or use of the Platform.
5. Nature of Platform and Scope of Services
a) The Platform is a technology intermediary operating as an automated search and data aggregation tool of publicly available job listings. It enables Users to:
- Upload, store, and manage CVs and professional information;
- Analyse CV content using automated and algorithmic systems;
- Identify employment opportunities published on third-party job websites; and
- Receive links to, and be redirected to, external job listings hosted on third-party platforms.
b) The Platform operates as a technology intermediary providing information location, indexing, aggregation, and matching services only. The Platform does not host, scrape, reproduce, copy, modify, or republish third-party job listings or content. All job-related results made available through the Platform consist solely of links and redirections to publicly accessible third-party job websites, generated through automated systems, with the intention of driving referral traffic to such websites and not replicating or substituting their content. The Platform does not access or provide content behind paywalls or restricted access mechanisms.
c) The Platform does not host, publish, curate, modify, or control job listings and does not act as an employer, recruiter, placement agency, head-hunter, or employment intermediary, nor does it provide recruitment or placement services within the meaning of Applicable Law.
d) The Platform provides information location, indexing, aggregation and matching services only. The Company makes no representations or warranties as to the availability, accuracy, completeness, legality, or currency of any external job listings, and does not guarantee interviews, employment offers, employer quality or standards, specific salary amounts, benefits, or any employment outcomes.
e) The Platform and the Company are not affiliated with, partnered with, sponsored by, endorsed by, or funded by any job board, recruitment website, employer, or employment listing platform.
f) In providing the Services, the Platform acts solely as a neutral technology intermediary and shall not be responsible or liable for:
- The content, accuracy, legality, or availability of third-party job listings;
- Decisions made by Users, employers, or job site operators;
- Any employment relationship, dispute, or transaction arising between
- Users and third parties; or
- Any acts or omissions of third-party job sites, employers, or recruiters.
g) The Platform shall be entitled to rely on applicable intermediary safe-harbour protections under Sri Lankan law and shall not be liable for third-party content or links, provided the Company acts without actual knowledge of unlawful content and complies with applicable notice-and-action obligations.
h) The Platform acts as a Data Controller in respect of personal data submitted by Users to the Platform and as a Data Processor or intermediary in respect of automated processing, indexing, and redirection functions performed in connection with third-party job listings. The Company does not determine the purposes or means of processing undertaken by third-party job sites or employers.
6. User Accounts and Responsibilities
a) Users shall provide information that is accurate, current, complete, and not misleading at the time of registration and shall ensure that such information is kept up to date at all times.
b) Users are solely responsible for:
- The accuracy and legality of their CV and uploaded information;
- Maintaining the confidentiality of their account credentials; and
- All activity conducted through their account.
- Safeguarding of login credentials.
c) Users shall not upload content that is false, misleading, defamatory, unlawful, or infringing on third-party rights.
d) Users shall have the right to request the complete deletion of their account, profile, and associated personal data from the Platform, subject to and in accordance with the Privacy Policy and Data Deletion Workflow detailed herein.
e) Users are solely responsible for maintaining their own copies and backups of their CVs, career information, and any other data uploaded to or generated through the Platform. The Platform may, from time to time, be modified, paused, suspended, or discontinued, whether temporarily or permanently due to unavoidable circumstances and with due notice, and the Company does not guarantee the continued availability or retrievability of data in such notified events. While the Company shall take reasonable steps, subject to the terms and conditions of applicable third-party hosting or server providers, to restore services or data where practicable, the Company shall not be liable for any loss, deletion, or inability to recover User data arising from notified Platform changes, interruptions, or third-party service failures.
7. Acceptable Use Policy
a) The Acceptable Use Policy (“AUP”) governs the expressly permitted and prohibited uses of the Platform by Users and forms an integral part of the Terms and Conditions. For the avoidance of doubt, the permitted and prohibited uses of the Platform are determined by the Terms and Conditions as a whole and are not limited to the provisions set out in the AUP.
b) Users shall not, directly or indirectly:
- Upload false, misleading, defamatory, or fraudulent information, including falsified CVs or credentials.
- Upload content containing malware, spyware, or harmful code.
- Use the Platform to harass, discriminate, or violate the rights of others.
- Attempt to reverse-engineer, scrape, copy, or misuse the Platform’s algorithms or data.
- Circumvent access controls, subscription limits, or payment systems.
- Use the Platform for unlawful purposes under Sri Lankan law or applicable foreign law.
- Impersonate another person or entity.
- Use Platform links to perform scraping or automated extraction from third-party job sites
- Violate the terms of any third-party job platform accessed through provided links.
c) The Platform and Company reserves the right to:
- Monitor usage patterns for the purpose of ensuring AUP and Terms & Conditions adherence or violation.
- Suspend or terminate access for violations.
- Remove content where legally required or necessary for platform integrity.
d) Users remain solely responsible for the accuracy, completeness, legality, and authenticity of all information, data, and content uploaded to or submitted through the Platform. The Platform does not verify, validate, or guarantee the correctness, accuracy, or legality of any CVs or other user-submitted data.
e) Any failure or delay by the Company or the Platform to enforce this AUP or any provision of the Terms and Conditions shall not be construed as a waiver of any right, power, or remedy.
f) Any violation of this AUP or the Terms and Conditions may result, at the Company’s sole discretion, in immediate suspension or termination of access to the Platform, forfeiture of any active subscription without refund, and, where necessary, the initiation of legal action, including applications for interim, injunctive, or other equitable relief and remedies available under Applicable Law.
g) Users may submit inquiries, requests, complaints, or notices relating to the Platform, these Terms and Conditions, the Privacy Policy, or any other matters reasonably within the scope of the Platform by sending an email to the Email Address, by completing and submitting the Online Form, or by contacting the Company via the Contact Number, as applicable. This includes the reporting of any suspicious, fraudulent, or otherwise concerning activity relating to third-party job sites to which links are provided through the Platform. Any such reports shall be reviewed by the Platform in good faith, and the Platform may, at its sole discretion, take such action as it deems appropriate, including restricting or excluding such job sites from the Platform, without admission of liability, and for the sole purpose of improving the overall user experience.
h) The availability of any feature enabling Users to report third-party job sites and their links shall not be construed as an acceptance of, or assumption of, any liability by the Platform or the Company in respect of such links. As provided herein, the access to, use of, functionality of, and reliance upon any third-party job site links fall outside the scope of these Terms and the Company’s liability, and shall be governed exclusively by the terms, conditions, and policies of the respective third-party job sites, within their applicable scope of responsibility and liability.
8. Service Packages
a) The Platform may, at its discretion, offer a no-payment or free service package, which may include limited features such as restricted CV uploads, job matching functionality, access to search results, and other Platform features, and which may be limited to the local Sri Lankan employment market.
b) The Platform offers one or more paid subscription packages, which may include enhanced features such as larger/unlimited volume of uploads, advanced CV analysis, increased job discovery volume, priority matching or alerts, additional tools or insights and access to both Sri Lankan and foreign employment markets. The features, pricing, billing cycle, and duration applicable to each paid package shall be disclosed on the Platform.
c) The scope, availability, features, limitations, and duration of any free or paid package shall be determined solely by the Company. The Company reserves the right to modify, restrict, suspend, or withdraw any free or paid package at any time, subject to notice being given to subscribers prior to the next applicable billing cycle and in accordance with any notice requirements under Applicable Law. No such change shall give rise to any entitlement, legitimate expectation, or claim on the part of the User, save for the right to cancel the services in the manner and within the time frames provided herein or pursuant to such notice.
9. Payment, Billing, and Cancellation Policy
a) Upon registration for any paid package, Users shall provide valid, current, and authorized credit or debit card details.
b) Billing shall be conducted on a recurring cycle basis, as determined by the subscription package selected by the User (including weekly, monthly, quarterly, or such other cycle as may be specified). Payment for each billing cycle shall be due and payable in advance at the commencement of the relevant cycle, and all applicable charges shall be automatically debited from the User’s registered card.
c) All fees and charges paid are strictly non-refundable, whether in whole or in part, and regardless of actual use, non-use, early termination by the User, or termination arising from any breach or violation of these Terms.
d) Users may cancel their subscription at any time. Any such cancellation shall take effect only upon expiry of the then-current billing cycle, and no pro-rated refunds, credits, or reimbursements shall be provided under any circumstances.
e) Subject to the provisions of these Terms, Users may request the cancellation of their subscription by using the relevant cancellation function made available on the Platform, by sending an email to the Email Address, or by submitting a request through the Online Form.
10. Trial Period for Paid Subscriptions
a) The Platform/Company may, at its sole discretion, offer trial periods in respect of selected paid subscription packages. The duration of any such trial period and the paid subscription packages to which a trial period applies shall be determined exclusively by the Company.
b) Eligibility for a trial period shall be subject to User registration and the provision of valid credit or debit card details at the time of sign-up.
c) Users may cancel the applicable paid subscription at any time during the trial period without charge. Where the User fails to cancel the subscription prior to the expiry of the applicable trial period, the relevant subscription fee shall be automatically charged to the User’s registered payment method on the day immediately following the expiry of the trial period, and the subscription shall thereafter continue in accordance with the applicable billing cycle.
d) Trial periods shall apply only to paid subscription packages and shall not be available to Users subscribed solely to any free package.
e) Each User shall be entitled to one (1) trial period only, unless expressly permitted otherwise by the Platform in writing.
f) The Company reserves the right to restrict, suspend, or deny access to trial periods where it reasonably determines that a User has attempted to obtain multiple trial periods through the creation of multiple accounts, the use of different email addresses, payment instruments, devices, IP addresses, or by any other method intended to circumvent trial limitations.
g) Any such conduct shall constitute a misuse of the Platform and may result in immediate suspension or termination of the User account, without prejudice to any other rights or remedies available to the Company under these Terms or Applicable Law.
11. Refund Policy
a) All fees and charges paid to the Platform are strictly non-refundable in all circumstances, whether in whole or in part, and no refunds, credits, chargebacks, or reimbursements shall be issued for any reason whatsoever. The Platform operates on a cancellation-only basis.
b) Users may cancel their subscription at any time; however, any such cancellation shall take effect only upon expiry of the then-current billing cycle. The User shall remain liable for all fees due for the ongoing billing cycle, and no pro-rated refunds, partial credits, or adjustments shall be provided under any circumstances.
12. Job Site Owner : Rights, Dialogue, and Takedown Mechanism
a) The Platform does not scrape or reproduce job listings, and Provides links and redirections only and Intends to drive referral traffic to third-party job websites, and not content replication. All links aggregated and provided to users are publicly accessible, not behind paywalls, and not scraped in a way that copies content.
b) The Platform operates as a technology intermediary providing information location, indexing, aggregation, and matching services and does not host, scrape, reproduce, or modify third-party job listings, and only provides links and redirections, generated through automated systems, and intends to drive traffic to third-party job websites.
c) The Platform, in indexing, aggregating, matching, redirecting, and providing links, makes no claim of ownership over any third-party job listings or content and shall at all times provide such links with clear attribution to the third party source job sites, while respecting applicable technical restrictions, access controls, and valid takedown notices, subject to the mechanisms provided herein.
d) If any Job Site Owner believes that the Platform’s indexing, linking, or redirection to content originating from their website infringes their rights, policies, or legal interests, such Job Site Owner shall first raise a request through the Online Form or by a written request via email to the Email Address for clarification, modification, takedown, and/or a meeting/discussion to resolve concerns amicably.
e) Upon receipt of a valid request, the Company shall acknowledge receipt and engage in good-faith dialogue with the Job Site Owner to clarify the concern, assess the request, and explore reasonable technical or operational resolutions, including modification, restriction, or removal of indexing or linking, where appropriate and lawful.
f) The Company shall not be obliged to immediately remove links or search results unless required by Applicable Law, a court order, or a competent authority, but shall act reasonably and proportionately during the dialogue and review process.
g) The parties in such dialogue agree that good-faith engagement, dialogue, and technical resolution under this clause shall be a mandatory first step prior to the initiation of any legal proceedings, except where urgent interim relief is required under Applicable Law.
h) Where appropriate, the Company may voluntarily suspend or modify access to specific links during discussions, without admission of liability.
i) Nothing in this Clause shall be construed as an admission of liability by the Company, nor as a waiver of any statutory intermediary protections, safe-harbour provisions, or defenses available under Applicable Law.
12. Privacy Policy
a) Platform collects personal data as listed herein and in the Schedule hereto, which may include:
- Identification data;
- Contact information;
- CV and employment history;
- Account and usage data;
- Payment-related metadata (excluding full card numbers);
- Technical and device data.
b) The said data may be processed for providing and improving Services, Job matching and analytics, Billing and account management, Legal compliance and dispute resolution, and managing Platform functionality.
c) The said data shall be processed solely on the basis of User consent, for purposes necessary to perform this Agreement, or to comply with legal obligations. At all other times, such data shall be encrypted and otherwise protected against unauthorized access, use, or disclosure. In particular, all passwords shall be securely hashed and shall never be stored in plain text.
d) The said data may be processed for email verification solely for the purpose of ensuring account security and preventing unauthorized access.
e) The Company has designated a Data Protection Team responsible for overseeing compliance with applicable data protection laws. Users and other data subjects may contact the Data Protection Team to raise inquiries, requests, or concerns relating to personal data processing by submitting a request through the Online Form made available on the Platform.
f) CV Processing Transparency:
- The Platform processes CVs using automated systems, including algorithmic and machine-assisted tools, solely for the purposes of analyzing content, identifying relevant job opportunities, and generating job-matching results.
- CVs uploaded to the Platform are not subject to human review, inspection, or manual assessment by the Company, unless such review is expressly disclosed to the User or is required for technical support, legal compliance, or security purposes.
- The Platform does not engage in behavioral profiling, personality profiling, or decision-making beyond automated job-matching functions. CV processing is limited strictly to assessing relevance against job-related criteria and does not produce legal or similarly significant effects on Users.
- The Platform does not transmit, share, or disclose Users’ CVs or personal data to any third-party job site unless and until the User affirmatively chooses to access such job site and consents to any data sharing required by that third party.
g) Where a User is redirected to a third-party job site, such interaction is governed solely by the terms, conditions, and privacy policies of that third-party site. The Company has no control over, and assumes no responsibility for, the data practices of such third parties.
h) The User shall exercise independent due diligence, care, and judgment when engaging with any job listing or third party job site, including being aware that fraudulent or scam job listings, impersonation schemes, and deceptive recruitment practices may exist.
i) Users are encouraged to independently verify the identity and credibility of employers and recruiters, to exercise heightened caution where communications occur exclusively via informal channels such as messaging applications, and to be vigilant of offers that appear unrealistic or beyond regular norms and expectations.
j) The Platform does not support, endorse, or promote any job opportunity that requires candidates to make payments of any kind, including but not limited to registration fees, placement fees, visa fees, training fees, advance payments, or upfront payments. Users are expressly warned not to transfer money, share one-time passwords (OTPs), disclose banking credentials, or provide sensitive personal or financial information to any third party. Any User who nevertheless makes such payments or disclosures does so entirely at their own risk and subject to the terms and conditions of the relevant third-party websites or platforms, and shall have no claim against, nor hold the Platform or the Company liable for, any loss, damage, or consequence arising therefrom.
k) Where the Platform provides links to overseas employment opportunities, the User acknowledges that such roles carry additional legal and practical risks and that the User is solely responsible for verifying visa requirements, recruiter authorization, employer legitimacy, and compliance with applicable migration, labour, and employment laws. Any failure to exercise such due diligence shall be at the User’s own risk, and the Platform and the Company shall not be liable for any loss, damage, or harm arising therefrom.
l) Personal data may be shared with service providers and processors, including hosting providers, and with legal or regulatory authorities where required by Applicable Law. The Company shall ensure that appropriate contractual and technical safeguards are in place to protect such data.
m) Where payments for the Platform Services are processed through third party payment gateways or payment service providers, such processing shall be subject to the respective terms, conditions, policies, and procedures of such payment gateway or service provider. The Platform and the Company shall not be responsible for, and the Platform’s Terms and Conditions shall not govern, the operation, processing, security, or failure of such payment services.
n) In the event that a Force Majeure Event impacts the Platform’s servers, data storage, hosting environment, or disaster recovery systems, the terms, conditions, service level agreements, and disaster recovery policies of the relevant third-party storage and server services providers shall apply. The Company shall take reasonable steps, consistent with such third-party terms, to restore services where practicable, but does not guarantee uninterrupted access, data availability, or recovery timelines
o) The Company shall not sell, rent, or trade personal data/Content to any third party.
p) Personal data shall be retained only for as long as is necessary to fulfil the purposes for which it was collected or as otherwise required or permitted under Applicable Law.
q) The Company implements reasonable technical and organizational measures designed to protect personal data against unauthorized access, loss, misuse, alteration, or destruction.
r) The Company implements reasonable technical and organizational measures to protect personal data, including but not limited to encryption of data at rest and in transit, access controls, authentication mechanisms, and system monitoring.
s) Access to personal data is limited to authorised personnel and service providers on a need-to-know basis and subject to contractual confidentiality and data protection obligations.
t) The Company maintains internal procedures for detecting, responding to, mitigating, and documenting personal data security incidents, including unauthorised access, disclosure, alteration, or loss of data.
u) Personal Data Breach Notification:
- In the event of a suspected or actual personal data breach, the Company shall promptly assess the nature, scope, and potential impact of the incident in accordance with its internal breach management protocol.
- Where a personal data breach is likely to result in a real risk of harm to Users, the Company shall notify affected Users within a reasonable period and in accordance with Applicable Law.
- Where required by law, the Company shall notify the relevant regulatory authority of any reportable personal data breach within the prescribed time frames.
v) Users may, subject to Applicable Law, have rights of access, correction, erasure, restriction of processing, and withdrawal of consent, including the right to manage and delete their CV data and job-matching data at any time through the Platform or by contacting the Company.
w) Where personal data is transferred outside Sri Lanka, the Company shall ensure that appropriate safeguards are implemented in accordance with Applicable Law.
x) Users and job site owners may raise privacy or data protection concerns through the designated contact mechanism provided on the Platform.
y) This Privacy Policy may be updated from time to time. Continued use of the Platform following the publication of an updated Privacy Policy shall constitute acceptance of such updated policy, subject to Applicable Law.
14) Account Deletion Workflow
a) Right to Request Deletion
Users shall have the right to request the deletion or erasure of their account, profile, CVs, and associated personal data held by the Platform.
b) Request Mechanism
All deletion requests shall be submitted through the designated account settings, support interface, or contact mechanism provided on the Platform. The Company may require reasonable verification of the User’s identity before processing any such request.
c) Processing of Deletion Requests
Upon receipt of a valid deletion request, the Company shall, within a period of Three (3) Working Days (or any such period in accordance with requirements of Applicable Law);
- Permanently delete the User’s personal data from active systems.
- Ensure that such data is no longer processed for any purpose other than those permitted under Applicable Law.
d) Restore Request
User may, after submitting a valid deletion request and prior to the expiry of three (3) Working Days (or such other period as may be notified as applicable at the relevant time), request the cancellation of such deletion by sending an email to the Email Address or through any other specific means noticed by the Platform. Upon acceptance of such request, the Company may restore the User’s account to its status immediately prior to the deletion request, subject to the then applicable Terms and Conditions and under the applicable subscription package.
e) Exceptions and Lawful Retention
Notwithstanding the foregoing, the Company may retain certain personal data where retention is:
- Required to comply with a legal obligation, regulatory requirement, court order, or lawful request by a competent authority.
- Necessary for the establishment, exercise, or defence of legal claims.
- Required for audit, fraud prevention, dispute resolution, or enforcement of the Company’s legal rights, provided that such retained data shall be restricted, securely stored, and not used for any other purpose.
f) Effect of Deletion
Upon completion of deletion, the User’s account shall be permanently deactivated, and access to Platform services shall cease. Deletion of data may result in the loss of all CVs, job matches, preferences, and related content, and such deletion shall be irreversible.
g) Third Parties and Processors
Where personal data has been shared with service providers or processors acting on behalf of the Company, the Company shall take reasonable steps to notify such parties to delete the relevant data, subject to contractual, technical, and legal limitations.
h) Confirmation
The Company shall, where required by Applicable Law or reasonably practicable, notify the User upon completion of the data deletion process.
15) Account Deletion Workflow
a) This Platform uses cookies and similar tracking technologies to enable core functionality, enhance user experience, maintain security, analyse platform performance, and support service delivery. Cookies may include essential cookies required for authentication and session management, functional cookies that remember user preferences, and analytical cookies used to understand usage patterns and improve the Platform. The Platform does not use cookies to sell personal data or to engage in intrusive behavioral advertising.
b) Users may manage or disable cookies through their browser or device settings; however, disabling certain cookies may limit access to features or impair Platform functionality. By continuing to access or use the Platform, Users consent to the use of cookies in accordance with this Cookie Policy, subject to their rights under Applicable Law.
16) Account Deletion Workflow
a) The Platform uses automated systems, including algorithmic and artificial intelligence based tools, to analyse CVs, match Users with potential employment opportunities, and generate search results and recommendations. These systems operate on predefined parameters and data inputs and are designed solely to facilitate job matching and information discovery. No automated decision-making on hiring, employment selection, or profiling beyond job matching is carried out by the Platform.
b) The Platform does not conduct human review of CVs or automated outputs unless expressly stated, and does not transfer CV data to third party job sites without the User’s explicit action or consent. Automated outputs are informational in nature and do not constitute guarantees of accuracy, suitability, or employment outcomes. Users remain responsible for reviewing results and exercising independent judgment when engaging with third-party job listings.
17) Limitation of Liability
a) This clause is intended to limit the Company’s liability to the maximum extent permitted under applicable law and does not affect any rights or remedies that cannot be excluded or limited by law.
b) The Platform is provided to Users on an “as-is” and “as-available” basis, without any representations, warranties, or guarantees of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, quality, accuracy, reliability, uninterrupted access, or non-infringement.
c) The Company does not warrant that the Platform will be error-free, free from defects, secure, or operate without interruption, delay, or downtime, or that it will meet any User’s specific requirements, expectations, or objectives. Without prejudice to the foregoing, any Artificial Intelligence generated analyses, rankings, or match scores produced by the Platform are indicative only, may be incomplete or imperfect, and are provided for informational purposes only. Such outputs do not constitute assessments of a User’s competence, potential, suitability, or employability, and Users shall not rely on them as definitive in making employment related decisions.
d) Access to and use of the Platform is solely at the User’s own risk. The Company disclaims all liability for:
- Any errors, defects, bugs, or inaccuracies in the Platform;
- Any unavoidable interruptions, outages, downtime, or unavailability of the Platform;
- Any loss of data, delays, or other consequences arising from the use of, or inability to access, the Platform.
e) To the maximum extent permitted by law, the Company shall not be liable for:
- Loss of employment opportunities;
- Third-party website content or actions;
- Indirect, incidental, or consequential damages.
f) The Platform and the Company shall not be liable to any third-party job site, Job Site Owner, employer, or recruitment platform for any loss, damage, claim, or liability arising out of or in connection with redirected Users accessing and interacting with such third-party job sites in bad faith, including by any acts, omissions, misconduct, misrepresentations, inaccuracies, unlawful practices, or failures attributable to Users, candidates, employers, or such third-party job sites, whether occurring in good faith or otherwise.
18. Force Majure
Neither the Platform nor the Company shall be liable for any failure, delay, interruption, suspension, or degradation in the performance or availability of the Platform or Services arising out of or in connection with any event beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, fire, flood, war, terrorism, civil unrest, strikes, power or internet outages, governmental actions, or failures of third-party infrastructure, hosting services, cloud service providers, payment gateways, or telecommunications networks (“Force Majeure Event”).
19. Termination
a) The Platform and/or the Company reserve the right to suspend or terminate a User’s access to the Platform where the User is in breach of these Terms or any Applicable Law.
b) Termination shall not affect any fees, charges, or payment obligations accrued prior to the effective date of termination, all of which shall remain due and payable.
c) Termination hereunder shall have the following effects, without limitation and subject to the specific circumstances and requirements of each instance;
- Upon termination hereunder for any reason, the User’s right to access or use the Platform and Services shall immediately cease, subject to any limited access expressly permitted for account closure or data retrieval in accordance with the Privacy Policy and Applicable Law.
- The Company shall be entitled to suspend or permanently delete the User’s account and associated data in accordance with its data retention and deletion obligations under Applicable Law and the Privacy Policy.
- Any licenses granted by the Company to the User shall automatically terminate, and the User shall immediately cease all use of the Platform, software, branding, and proprietary systems.
- Any licenses granted by the User to the Company with respect to data and Content shall automatically terminate, and the Company shall immediately cease all use of the User’s data and Content.
- Termination shall be without prejudice to any rights, remedies, or causes of action accrued to either Party prior to termination, including the right to seek injunctive relief, damages, or other legal remedies under Applicable Law.
20. Intellectual Property
a) All Platform software, design elements, branding, user experience (UX) and user interface (UI), algorithms, databases, artificial intelligence systems, functionalities, features, copyrights, intellectual property of any kind and proprietary systems of the Platform shall at all times remain the exclusive property of the Company. For the avoidance of doubt, links to, and content originating from, third-party job sites are expressly excluded and remain the property and responsibility of the respective third parties.
b) Users shall retain ownership of their CVs and other personal Content submitted to the Platform. By uploading or submitting such content, Users grant the Company a limited, non-exclusive, revocable licence to host, process, analyse, reproduce, and use such content solely for the purpose of providing and improving the Services in accordance with these Terms and the Privacy Policy.
21. Confidentiality
a) Users are solely responsible for ensuring any confidentiality requirement, personal or otherwise, for any information obtained through the Platform, including any copying, downloading, replication, or onward use of such information by the User.
b) The Company shall be responsible only for maintaining the confidentiality and security of data within its control, including User account information, CV data, and personal data processed through the Platform, in accordance with these Terms and the Privacy Policy.
22. Governing Law
These Terms, Conditions and Privacy Policy shall be governed by and construed in accordance with the laws of Sri Lanka, and subject to the exclusive jurisdiction of the courts of Sri Lanka, unless otherwise required by Applicable Law.
23. Survivability
Any provisions of this Agreement which by their nature, express terms or under Applicable Law are intended/required to survive termination shall so survive, including but not limited to provisions relating to confidentiality, data protection and privacy, intellectual property, limitation of liability, payment obligations accrued prior to termination, dispute resolution, governing law, and any rights or remedies that have accrued prior to termination.

- Is Email Verified – Indicates whether the user has confirmed their email address

Purpose: Stores uploaded CV/resume information and extracted details for job matching.

Purpose: Stores job listings collected from various sources for matching with user CVs.
- Title – Job title or position name
- Company – Name of the hiring company or organization

- Source – Where the job was found (e.g., Topjobs, LinkedIn, Google, etc.)

- Current Location – User’s current city or location
